This Privacy Notice is made on behalf of the Sterling Financial Corporation family of companies and is effective October 1, 2006 and supersedes any previous privacy notices issued by Sterling or any of its affiliates. This notice applies to all consumer customer relationships.

Sterling Financial Corporation and its affiliates have always been committed to providing you, our customers, with the finest financial products and services. While information about you is fundamental to our ability to do this, we understand the importance of respecting and maintaining the confidentiality and security of personal information entrusted to us by current and prospective customers. You can be assured that we protect our customers' privacy and will continue to do so.

We do not share your personal information with any outside party for marketing purposes unless that company is under contract with us to help serve you better. This allows us to offer products and services that may interest you and best meet your financial goals, whether they are available directly from us or through our relationships with these select companies.

In order to better service your accounts and financial goals, we collect and use various types of information about you. We value your relationship and we believe that protecting your personal information is key to providing you with the customer experience that you expect and deserve. This brochure explains the different categories of personal information that exist, what information we collect, what information we share and with whom, and how we protect your personal information. Definitions

Affiliate An affiliate is any company that controls, is controlled by, or is under common control with Sterling. See the current list of Sterling's affiliates above.
Consumer A consumer is an individual who obtains or has obtained a financial product or service from Sterling that is to be used primarily for personal, family, or household purposes.
Everyday business purposes The actions necessary by financial services companies to run their business and manage customer accounts, such as:
  • Processing transactions, mailing and auditing services
  • Providing information to credit bureaus
  • Responding to court orders and legal investigations
    Joint Marketing
    A formal agreement between non-affiliated financial companies that together market financial products or services to you.
    • Our joint marketing partners include credit card companies that brand our credit cards and insurance companies.
      Non-affiliates
      Companies not related by common ownership or control. They can be financial and non-financial companies.
      • We do not share any customer information with non-affiliated companies unless we partner with them to provide products and services to you.
        Non-public Personal Information
        Non-public personal information means personally identifiable information. Personally identifiable information is information:
        • That a consumer provides to obtain a financial product or service.
        • That is about a consumer and results from a transaction between Sterling and the consumer involving a financial product or service.
        • That Sterling otherwise obtains concerning the consumer in connection with the provisions of a financial product or service to the consumer.

        Examples of personally identifiable information include the following:

        • Information a consumer provides on an application to obtain a loan, credit card or other financial product or service.
        • Account balance information, payment information, overdraft history, and credit or debit card purchase information.
        • The fact that the individual is or has been a customer or has obtained a financial product or service from Sterling.
        • Any information provided by a consumer or otherwise obtained by Sterling in connection with collecting on a loan or servicing a loan.
        • Any information collected through an Internet "cookie."
        • Information from a consumer report, such as a credit report.

        The types of personal information that we collect and share depends on the product or service you have with Sterling.



        Your Personal Information: How we Collect It
        The information that we collect and use about you helps us to better serve your accounts and meet your financial goals. Some of the information is non-public personal information and other information is obtained from non-affiliates. The types of personal information are as follows:

        • Identification Information - information that identifies you, such as name, address, telephone number and Social Security Number.
        • Application Information - information you provide to us on applications and through other means that will help us determine if you are eligible for products you request. Examples include assets, income and debt.
        • Transaction and Experience Information - information about transactions and account experience, as well as information about our communications with you. Examples include account balances, payment history, account usage, and your inquiries and our responses.
        • Consumer Report Information - information from a consumer report. Examples include creditworthiness and credit history.
        • Information from Outside Sources - information from outside sources regarding employment, credit and other relationships that will help us determine if you are eligible for products you request. Examples include employment history, loan balances, credit card balances, property insurance coverage and other verifications.
        • Other General Information - information from outside sources, such as data from public records, which is not assembled or used for the purpose of determining eligibility for a product or service.

         As required by the USA PATRIOT Act, we also collect information and take actions necessary to verify your identification. To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. When you open an account, we will ask your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.

        Your Personal Information: How we Share It
        All financial services companies need to share customers' personal information to run their everyday business - to process transactions, maintain customer accounts, and report to credit bureaus. In the section below, we list the reasons financial services companies can share their customers' personal information, the reasons Sterling chooses to share and whether you can limit this sharing. When the name "Sterling Financial Corporation" is used below, we are referring to any one or more of Sterling's banking and financial services affiliates with which you maintain or have maintained account relationships or through which you have completed any financial transactions. The reference to "our affiliates" refers to any one or more of Sterling's banking or financial services affiliates with which you do not currently have an account or other relationship.

        Why can't I limit all sharing? Federal law gives you the right to limit sharing only for:
        • Affiliates' everyday business purposes-information about your creditworthiness
        • Non-affiliates to market to you

        State laws and individual companies may give you additional rights to limit sharing. Because we do not share any information that we are not allowed by law to share, you do not have the right to limit our sharing.


        Your Personal Information: How We Protect It
        To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards, audit and control programs, secured files and buildings as well as employee policies, procedures, employee orientation, training and education programs designed for the protection of customer information.


        Sharing Information with Third Parties in Special Circumstances
        We may disclose any of the types of personal information identified above to credit bureaus and similar organizations and when required or permitted by law. For example, customer information may be disclosed in connection with a subpoena or similar legal process, fraud prevention or investigation, including identity theft, risk management and security, and recording of deeds of trust and mortgages in public records. Customer information may also be disclosed to companies that process your requests for products or services or in connection with the sale or servicing of your account to another financial institution. We may report information about your loan to credit bureaus. Late payments, missed payments, or other defaults on your loan may be reflected in your credit report.


        How often does Sterling Financial Corporation notify me about their practices?
        We must notify you about our sharing practices when you open an account and annually while you are a customer. The policies and practices described in this disclosure are subject to change, but we will communicate any significant changes to you as required by applicable law.
